Guarantee
Please include Our Reference Number in all correspondence.
- The artwork Description and information provided therein states the total basis of an artwork purchase/sale. Please read this relevant and important information on our Website, including Guarantee, Other Art Info and About Us which together with the Description all form the complete information and terms and conditions of a purchase/sale.
- We purchase artwork from suppliers or sources who are usually known to us and/or are
a normal part of our business. We offer signed and unsigned artwork on our Website as purchased by us and as stated in
the Description.
- A Certificate of Authenticity, including any of the types named below, shall be provided: if stated in the Description; within the terms and conditions on our Website; as received by us [where applicable]; and as a copy of in some cases.
- Our Certificate of Authenticity will list the details of the artwork shown and may be issued in the name of Art Bank Brokers Ltd. or other trade name used by us.
- A Certificate of Authenticity, or other such information indicating authenticity, may be from another source, including, but not limited to, the Publisher or Printer.
- A Justification du Tirage or Colophon is the original Certificate of Authenticity which usually states the edition number and
edition size along with other details as published or printed.
- A Certificate of Authenticity from a Member of International Fine Art Appraisers [IFFA] is supplied to us by the viewing of digital image[s], including signature and other marking[s], as applicable. We are not associated with the IFFA Member who provided the Cerificate of Authenticity to us and have paid for this service. This certification was obtained at an earlier date and may not be current.
- Packaging or other inclusion, that is part of an artwork, will be provided if stated in the Description and as received by us.
- Our Guarantee: We guarantee that if an artwork is not accurately described [and with resonable proof thereof] in the Description and within the information and terms and conditions stated on our Website,
we will issue
a refund of the artwork purchase/sale price paid to us [excluding, where applicable, shipping, insurance, custom framing, other art services, import duty, excise tax, sales tax and other such costs and charges]
on the satisfactory return of the artwork to us in its original condition as sold.
Return authorization instruction in writing is required from us prior
to accepting a return. In some circumstances, a replacement artwork or exchange may be made at our discretion.
- We will correct an error, if known, in the Description and on our Website, as applicable. Please
advise us by email if you notice an error.
Typographical and other minor errors that do not affect the materiality of an artwork will be taken as correct. The information and terms and conditions on our Website are subject to change or update by us without notice and the such most recent shall apply.
- An estimate of value, appraisal, and/or other art evaluation by us should not be taken as being an
independent opinion.
- The Title of an artwork may be the known title or name,
the also known as title or name, or our title or name given to an artwork.
- The artwork that we sell is often purchased by us on the secondary market.
Most artwork is sold in the state and condition as purchased.
We may mat, frame, restore, or otherwise enhance an artwork by pressing, trimming, etc., but we usually sell an artwork in the same state and condition as purchased.
Please note that an older artwork often shows aging which is normal and expected with time.
- Our Guarantee is only as stated and not an expressed or implied warranty of any kind.
All artwork is sold "as is" and without a right to the Buyer or others and with no obligation or responsibility by us for any costs, fees, charges,
claims, losses, damages or liabilities of any nature, kind or consequence whatsoever growing out of or concerning the use of our Website or a purchase/sale, and all of which shall be collectively referred to as Costs herein. Such Costs incurred or otherwise claimed by the Buyer or any other party or parties shall be limited to the artwork purchase/sale price paid to us. Said limited liability shall all also apply in a case of neglect or default by us.
A Certificate of Authenticity, being any of the types named above, suppied to the Buyer is not a Guarantee.
- Our Guarantee is only for the Buyer and for 2 years from the purchase/sale date, and is not transferrable.
